Proof in civil procedural law should be based on formal truth with documentary evidence (authentic deed) as the main proof. In Decision Number 65/PDT.G/2025/PTA.Bjm, there is an error where the judge prioritized substantive truth over authentic deeds based on electronic evidence, which serves as preliminary evidence. This research aims to analyze the judge's considerations in assessing the hierarchy of evidence and the legal implications of applying the standard of material truth in the inheritance case. This study uses a normative juridical method with a case approach. Primary data were obtained from copies of appellate court decisions, while secondary data were obtained from legal literature and regulations. Analysis shows that the Panel of Judges made an error in applying the conviction raisonnee standard (judicial conviction). The use of WhatsApp conversations as buitengerechtelijke bekentis (extrajudicial confession) to weaken the birth certificate is procedurally incorrect because such evidence does not possess perfect evidentiary strength. Enforcement of substantive truth in civil cases without opposing evidence equivalent to an authentic deed can create legal uncertainty and weaken the position of the authentic deed as a perfect legal instrument.
