Penerapan Hukum Adat Aluk Todolo dalam Penyelesaian Delik Adat pada Masyarakat Toraja

This study aims to analyze the application of the Aluk Todolo customary law in resolving customary violations within the Toraja community and to understand the role of customary institutions in maintaining social order alongside the national legal system. This research employs a qualitative approach with an empirical legal research design. Data were collected through observation, interviews with customary leaders and community members, and documentation of customary dispute resolution practices in the Toraja area. The collected data were analyzed using descriptive qualitative analysis to explain the mechanisms of dispute resolution based on the values, norms, and sanctions embedded in the Aluk Todolo customary law. The results show that Aluk Todolo customary law still plays a significant role in resolving customary violations within the community. The settlement process is conducted through customary deliberations involving traditional leaders, the families of the disputing parties, and local community members. The sanctions imposed are not merely punitive but also aim to restore social harmony and balance within the community. The existence of this customary legal system indicates that local legal traditions remain relevant and can coexist with state law in maintaining social order and preserving the cultural values of the Toraja people.
Penelitian ini bertujuan untuk menganalisis penerapan hukum adat Aluk Todolo dalam penyelesaian pelanggaran adat pada masyarakat Toraja serta memahami peran lembaga adat dalam menjaga keteraturan sosial di tengah sistem hukum nasional. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian hukum empiris. Data diperoleh melalui observasi, wawancara dengan tokoh adat dan masyarakat setempat, serta studi dokumentasi terhadap praktik penyelesaian perkara adat di wilayah Toraja. Data yang terkumpul kemudian dianalisis secara deskriptif-kualitatif untuk menggambarkan mekanisme penyelesaian sengketa berdasarkan nilai, norma, dan sanksi dalam hukum adat Aluk Todolo. Hasil penelitian menunjukkan bahwa hukum adat Aluk Todolo masih memiliki peran penting dalam menyelesaikan pelanggaran adat yang terjadi di masyarakat. Proses penyelesaian perkara dilakukan melalui musyawarah adat yang melibatkan pemangku adat, keluarga pihak yang berselisih, serta masyarakat setempat. Sanksi yang diberikan tidak hanya bersifat hukuman, tetapi juga mengandung nilai pemulihan hubungan sosial dan keseimbangan komunitas. Keberadaan hukum adat ini menunjukkan bahwa sistem hukum lokal tetap relevan dan berjalan berdampingan dengan hukum negara dalam menjaga ketertiban serta kelestarian nilai budaya masyarakat Toraja.
